1) My Smoke-Free Lifestyle Contest

Participation in this Contest constitutes acceptance of all rules and decisions, consent to use and release of claims. This Contest is void where prohibited by law, and all federal, provincial and municipal laws apply.
To be eligible for prizes in this Contest, you must be a legal resident of the Province of British Columbia, and must be at least 19 years of age.

This contest is in no way endorsed by or affiliated with Facebook or Wildfire Interactive. The information you provide is being submitted to The Heart and Stroke Foundation of Canada’s Quitters Unite campaign (“QU”) and not Facebook or Wildfire Interactive. This information will only be used in the ways set forth in these terms and conditions.

1)    The Contest

The ”My Smoke-Free Lifestyle Contest” (“Contest”) will run in three phases. 1) The Submission Phase begins October 3rd at 10:00:00 AM PST and runs until November 12th at 11:59:59 PM PST. The Semi-Finalist Voting Phase begins November 16th at 10:00:00 AM PST and runs until November 26th at 11:59:59 PM PST. The Finalist Voting Phase begins January 6th at 10:00:00 AM PST and runs until January 21st at 11:59:59 PM PST.

2)    Contest Entry

a.    Submission Phase

The Submission Phase begins at 10:00AM on October 3rd and runs until 11:59:59PM on November 12th. During this round, entrants share their smoke-free lifestyle activity, or more specifically, what they would do with $300. To enter the contest, an entrant submits a description of his/her activity along with a relevant photo using the contest application on www.facebook.com/quittersunite or to the Quitters Unite website at www.quittersunite.com. Entrants will have to agree to these terms and conditions and provide personal information like full name and email address in order to enter the contest. This information will only be used to identify and contact you should you win. One entry per Facebook account allowed.

At the end of the submission phase, a panel of judges from the Heart and Stroke Foundation will select their 20 favourite activities, and the entrants who submitted these activities will be contacted via email and will move on to the semi-finalist voting phase. The decision of this panel is final and incontestable.  The panel will be looking for activities that are both unique but also realistic to undertake, as in the Filming Phase of the contest 5 of these 20 entrants will engage in their smoke-free lifestyle activity.

b.    Semi-Finalist Voting Phase

The Semi-Finalist Voting Phase will run from 10:00AM on November 16th to 11:59:59PM on November 26th. During this round, the 20 entries selected by the panel of judges will be uploaded to the online voting platform which can be accessed on the Quitters Unite Facebook page at www.facebook.com/quittersunite or the Quitters Unite website at www.quittersunite.com. This round is an opportunity for semi-finalists to promote their activities to their online social network and try to secure the most votes. People will be able to vote for as many different activities as they like, though only once per day for each individual idea.

At the end of this round, the 5 semi-finalists with the most votes will move on to the filming phase as Contest finalists.

c.    Filming Phase

Between November 30th and December 31st, the 5 semi-finalists that secure the most votes for their activities in the Semi-Finalist Voting Phase will engage in their activities. QU will arrange for the submitted activities of these finalists to take place, including covering any associated costs up to $300. The QU team will work with these finalists to coordinate the timing of these activities so that they can be filmed by the QU film crew. If for some reason a chosen activity becomes unrealistic to engage in and/or film, the QU team will work with the finalist who submitted the activity to find another activity that is possible to film.

Finalists will be expected to work with the QU film team to produce a short video that represents the values of QU, and does not contain any content whatsoever which would reasonably be understood to be defamatory, threatening, distasteful, racist, discriminating, unlawful or otherwise objectionable.

Any entrant who refuses to or is unable to coordinate with the QU team to partake in their activity and have it filmed will be disqualified from the contest. This includes, but is not limited to, entrants who refuse to sign an indemnification waiver or talent release form at or before the time of filming, as well as entrants who are out of the province for the period of the Filming Phase.

If a finalist is disqualified during the filming stage and time permits, the semi-finalist with the next most votes in the Semi-Finalist Voting Round will then become a finalist. If a finalist is disqualified at a stage in the phase when coordinating a new activity is unrealistic, the Final Voting Phase will proceed with fewer than 5 entrants. QU reserves the sole right to determine what is and what is not a realistic time frame for coordinating an activity.

d.    Final Voting Phase

The Final Voting Phase will run from 10:00AM on January 6th to 11:59:59PM on January 21st, 2012. The videos of the 5 finalists engaging in their submitted activities will be uploaded to the online voting platform which can be accessed on the Quitters Unite Facebook page at www.facebook.com/quittersunite or the Quitters Unite website at www.quittersunite.com. Finalists will promote their videos to their social networks and try to secure the most votes. People will be able to vote for as many different videos as they like, though only once per day for each individual idea.

At the end of this round, the finalist with the most votes will be declared the grand prize winner and will win an iPad 2.

e.    Other Legal Stuff

By entering in this Contest you agree to the terms and conditions set out above and below, so be sure to read them carefully. The decisions of QU will be considered binding in all affairs related to this Contest. QU reserves the right to disqualify entrants at their sole discretion if it is reasonably suspected that an entrant has tampered with the entry process, the Contest, or the website, or is acting in an uncooperative, unsportsmanlike, disruptive, abusive, or threatening manner.

QU reserves the right to make substitutions of equivalent kind or approximate value to the prizes listed above in the event of unavailability of any of the prizes or any component thereof. QU will not be liable to a winner or any other person for failure to supply the prize or any part thereof, by reason of the prize becoming unavailable or impracticable to award, or for any force majeure event, technical or equipment failure, terrorist acts, labour dispute, or act/omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause similar or dissimilar beyond the control of QU. No substitution for or transfer of any prizes by a Contest entrant will be allowed.

3)    Eligibility

People from all over the world are welcome to submit an entry, but only legal Residents of British Columbia will be eligible for prizes. Potential winners may be asked for proof of residency which may require them to send in a photocopy of government issued identification. Prizes and any mail addressed to a potential winner will only be sent to addresses in B.C. The Contest is void where prohibited or restricted by law. Entry to this Contest is only open to persons of at least 19 years of age.

This Contest is not open to anyone affiliated with Quitters Unite, NewAd, Domain 7, Context Research, The Heart and Stroke Foundation of B.C. & Yukon, BC Lung Association, Junction Marketing, Rebel Communications, CMYK Solutions, and Booje Media.

4)    Submission Requirements

Photos submitted to the Contest can be captured with any type of camera, though photos will have to be digitized by the creator in order to be entered in the Contest. Qualifying photos should contain no copyrighted material (beyond the QU logo and slogans). This means that you cannot use commercial copyrighted images. Activity descriptions may not contain obscene language or content, including but not limited to: profanity, explicit sexuality or graphic violence. Activities must be submitted via the Contest voting platform. If you are having problems submitting an activity, please contact us at info@quittersunite.com. If problems persist we will do our best to help but we accept no responsibility for an activity that misses out on our Contest due to technical difficulties, including but not limited to lost entries, transmission difficulties, website issues or computer failure. Acceptable photo formats are .jpg, .bmp & .gif.

5)    Propriety of submission content

Entrants in this Contest are responsible for any copyright infringements caused by their entries. QU assumes no responsibility for libellous claims made in the entries. QU assumes no responsibility for fees or royalties for anything or anybody contained in the submitted entries.

An entry:
(i) cannot, with the exception of QU and its logos and brands, show, contain, mention, depict, refer or otherwise allude to the name or logo of any manufacturer, brand, product, store, retailer, place of business, person, company or character;

(ii) cannot contain, mention, refer or otherwise allude to any sexually explicit or suggestive, obscene, lewd, violent, illegal, offensive, disparaging or inappropriate words, abbreviations, language, signs, products, symbols, political, personal and/or religious references or statements, including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group;

(iii) cannot promote illegal drugs or tobacco, firearms/weapons (or the use of any of the foregoing), or any particular political agenda or message;

(iv) cannot in any manner defame, misrepresent, contain disparaging remarks or reflect negatively about QU, its products or other people, products or companies or their products, or in any way reflect negatively upon such parties or communicate messages or images inconsistent with the positive images and/or goodwill with which QU wishes to be associated, as determined by QU in its sole discretion;

(v) cannot contain any personal identification, such as license plate numbers, email addresses or street addresses, without permission;

(vi) cannot contain copyrighted materials owned by others (including other photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media) without permission;

(vii) cannot depict, and cannot itself be in violation of any law; and

(viii) must otherwise be in compliance with all of the provisions of these official Terms and Conditions as stated herein. QU reserves the right at any time during the Contest period to remove an entry from the Contest or any website controlled by QU if it determines, in its sole discretion, that the entry does not comply with these official Terms and Conditions or that otherwise contains prohibited or inappropriate content and in the event of such removal, the entry will be disqualified and will not be eligible to compete for prizes.

6)    Notification of Potential Winners

QU will contact semi-finalists by email or phone as provided during Contest registration. The winning entries will be announced on the QU website, as well as the QU Facebook and Twitter pages. QU is not responsible for mistyped, stolen, lost, or misdirected email. If QU is unable to make contact with a prize winner within (8) days of attempted contact, or a prize winner fails to claim the prize in accordance with these Official Terms and Conditions, the prize will be awarded to the entrant of the activity with the next highest vote count in the case of the prizes awarded based on voting. In order to claim their prizes, the winners will be expected to cooperate with QU to get all necessary releases in place for their winning stories, and potential winners will be expected to answer a skill testing question prior to being named a winner. Instructions on how to claim prizes will be provided in the winner notification email.

7)    Representations/Warranties; Grants/Waivers; And Indemnification/Release as Conditions of Entry

By submitting an entry to QU in relation to the Contest you represent, warrant and undertake to QU that your entry:
(i) photo is your own original work and that you have the sole right to submit it to the Contest

(ii) does not violate in any way rights of third parties including copyright and other intellectual property rights and

(iii) does not violate any applicable laws.

In the event that you breach any of your representations, warranties or undertakings contained herein QU shall be entitled to and may seek indemnification from you for recovery of all legal fees, damages, claims and other expenses that may be incurred by QU or its affiliated entities as a result of your aforementioned breach.

Your contribution to the Contest should not include any content whatsoever which would reasonably be understood to be defamatory, threatening, distasteful, racist, discriminating, unlawful or otherwise objectionable.

QU reserves the right to alter or modify your contribution to the Contest without notification or consent from you.

QU reserves the right to change these Terms and Conditions at any time and at its sole discretion. Entrants agree to grant to QU an everlasting, royalty-free, assignable, exclusive license to use, utilize, replicate, alter, adapt, modify, publish, broadcast, translate, produce derivative works from, distribute, present, play, sublicense and exercise all copyright and other intellectual property rights with respect to your contribution worldwide and/or to include your contribution in other works in any media now known or later created forever. Each entrant agrees and grants QU permission to make available and display/perform and otherwise distribute entrant's first (given) name and entry submission, including finalist videos, in all media in perpetuity without compensation.

Except where legally prohibited, submission of an entry into this Contest constitutes permission for QU to use the entrant's first (given) name, entry, video, likeness, voice, city, province of residence and testimonials, in printed, broadcast media or new media, in perpetuity, in any manner they deem appropriate in connection with promoting the submission itself, this Contest, or QU, without further compensation in connection with this Contest or the prizes awarded.

QU shall have the right at any time to contact you to require proof of identity and/or eligibility or to require proof of identity, and/or eligibility of any third-party you assert has granted consent to participation in the Contest. Failure to provide such proof shall result in disqualification. All personal and other information requested by and supplied to QU for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. QU reserves the right, in its sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

Each entrant agrees to indemnify QU from any third party claims arising from or related to that entrant's participation in the Contest. By participating, entrants agree that QU in the development, production, implementation and distribution of this Contest and its owner The Heart and Stroke Foundation, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or QU shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify QU from any and all such claims, including the attorneys' fees related thereto. QU shall not be responsible for any technical malfunctions of the telephone network, internet, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury.

Any attempt made by any person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of applicable law. Should such an attempt be made, QU reserves the right to seek damages from any such person to the fullest extent of the law.

QU reserves the right to withdraw, terminate or modify all or any part of this Contest at any time if for any reason the Contest is not capable of running as planned, including technical failure or corruption, computer virus, tampering, unauthorized intervention, fraud or any other cause beyond the control of QU which in the opinion of QU affects the administration, security, fairness, integrity or proper conduct of this Contest.

8)    Facebook and Wildfire Interactive

This Contest is not in any manner sponsored, endorsed, administered by, or associated with Facebook or Wildfire Interactive. By participating in the Contest, each entrant releases and agrees to indemnify Facebook and Wildfire Interactive and hold them harmless from and against any and all costs, claims, damages, (including, without limitation, any special, incidental or consequential damages), or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Contest, or arising out of participation in any Contest-related or prize-related activity, or the receipt, enjoyment, participation in, use or misuse, of any Contest or prize-related activity, whether hosted by QU or a third party.

9)    Winners List

10)    Law

These are the official Contest Terms and Conditions. The Contest is subject to applicable federal, provincial and municipal laws and regulations. The Contest Terms and Conditions are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over QU. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Terms and Conditions or the rights and obligations as between the entrant and QU in connection with the Contest shall be governed by and construed in accordance with the laws of the province of British Columbia including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

11)    Language Discrepancy

In the event of any discrepancy or inconsistency between these official Terms and Conditions and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the Contest Terms and Conditions shall prevail, govern and control.

12)    General

BY ENTERING THIS CONTEST, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE OFFICIAL RULES AND YOU WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THESE OFFICIAL RULES.

2) Share Your Story Contest

Participation in this Contest constitutes acceptance of all rules and decisions, consent to use and release of claims. This Contest is void where prohibited by law, and all federal, provincial and municipal laws apply.

To be eligible for prizes in this Contest, you must be a legal resident of the Province of British Columbia, and must be at least 19 years of age.

This contest is in no way endorsed by or affiliated with YouTube. The information you provide is being submitted to The Heart and Stroke Foundation of B.C. & Yukon’s Quitters Unite campaign (“QU”) and not YouTube. This information will only be used in the ways set forth in these terms and conditions.

1) The Contest
The ”Share Your Quit Story” (“Contest”) will begin on January 13, 2012 at 10:00:00 AM PST and will run until March 10th at 11:59:59 PM PST.

2) Contest Entry
QU is looking for interesting and inspiring stories about smoking, including, but not limited to how you quit smoking, your successes and/or troubles with quitting smoking, your reasons why you would quit if you decided to, what you want to say to someone important to you about smoking or anything else that might inspire someone to quit smoking or not start. You can submit the stories in either written or video formats. The videos can be anything, from a monologue to a fully produced action/thriller, but keep them under 90 seconds. If you’re submitting a text story, keep it under 300 words. Once you have your video or story all ready to go, upload it to YouTube through the QU website. You will have to agree to these terms and conditions first, and you also have to register for a Quitters Unite account. Don’t worry it’s real quick. That’s all you have to do to get entered.

The following process will be used to determine the winners:

  • The top ten entries with the most votes will be reviewed by a panel of judges from the Heart and Stroke Foundation and BC Lung Association.
  • Stories will be reviewed for creative quality and overall effectiveness of infuencing young adult smokers to quit smoking or not start. *Note video submissions receive higher scores for creativity
  • Judges will vote independently of each other and rank their top five stories
  • The winners will be contacted to confirm eligibility and awarded their prize

 

The entrant who finishes in first place will receive a $300 Gift Card, the entrant who finishes in second place will get a $200 Gift Card, the entrant who finishes in third place will win a $100 Gift Card, 4th place a $75 Gift Card and5th place, a $50 Gift Card.  The winners of all of these Gift Cards will be able to choose one of three retailers to receive their Gift Cards from: Future Shop, Save-on-Foods, or Sport Chek.

To vote, people will simply go to the QU website. They will be able to vote for as many different stories as they like, though only once per day for each individual story.

4) Video and Text Story Creation Requirements
A video submitted to this Contest can be shot or filmed with any motion capture device, though it has to be digitized by the creator in order to be entered in the Contest. Qualifying videos should contain no copyrighted material (beyond the QU logo and slogans). This means that you cannot use commercial copyrighted music or images. Videos and text stories may not contain obscene language or content, including but not limited to: nudity, profanity, or graphic violence. Stories must be submitted via the website and not directly to YouTube. If you are having problems uploading a video or text story, please contact us at info@quittersunite.com. If problems persist we will do our best to help but we accept no responsibility for a story that misses out on our Contest due to technical difficulties, including but not limited to lost stories, transmission difficulties, website issues or computer failure. Acceptable video formats are all those accepted by YouTube including .asf, .wmv, .mov, .avi, .mpg, and .mp4.

5) Propriety of a story's content
Entrants in this Contest are responsible for any copyright infringements caused by their stories. QU assumes no responsibility for libellous claims made in entered stories. QU assumes no responsibility for fees or royalties for anything or anybody contained in the submitted stories.

A story:

As also stated above and below in these official Terms and Conditions, the posting of a story does not mean the story has been deemed to be in compliance with these official Terms and Conditions or YouTube’s Terms of Service and QU reserves the right at any time during the Contest period to remove the posting of a story from the Website or any website controlled by QU if it determines, in its sole discretion, that a story does not comply with these official Terms and Conditions or that otherwise contains prohibited or inappropriate content and in the event of such removal, the story will be disqualified and will not be eligible to compete for prizes.

6) Notification of Potential Winners
QU will contact winners by email as provided on the site registration. The winning stories will be announced on the QU website, as well as the QU Facebook and Twitter pages. QU is not responsible for mistyped, stolen, lost, or misdirected email. If QU is unable to make contact with a prize winner within (8) days of attempted contact, or a prize winner fails to claim the prize in accordance with these Official Terms and Conditions, the prize will be awarded; to the author of the story with the next highest vote count in the case of the prizes awarded based on voting; another random entrant in the case of the October random draws; or another judges’ pick in the case of the prizes based on judges’ selections. In order to claim their prizes, the winners will be expected to cooperate with QU to get all necessary releases in place for their winning stories, and potential winners will be expected to answer a skill testing question prior to being named a winner. Instructions on how to claim prizes will be provided in the winner notification emails.

Except where legally prohibited, submission of an entry into this Contest constitutes permission for QU to use the entrant's first (given) name, story, video, likeness, voice, city, province of residence and testimonials, in printed, broadcast media or new media, in perpetuity, in any manner they deem appropriate in connection with promoting the story submission itself, this Contest, or QU, without further compensation in connection with this Contest or the prizes awarded.

QU shall have the right at any time to contact you to require proof of identity and/or eligibility or to require proof of identity, and/or eligibility of any third-party you assert has granted consent to participation in the Contest. Failure to provide such proof shall result in disqualification. All personal and other information requested by and supplied to QU for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. QU reserves the right, in its sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

Each entrant agrees to indemnify QU from any third party claims arising from or related to that entrant's participation in the Contest. By participating, entrants agree that QU in the development, production, implementation and distribution of this Contest and its owner The Heart and Stroke Foundation of B.C. & Yukon, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or QU shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify QU from any and all such claims, including the attorneys' fees related thereto. QU shall not be responsible for any technical malfunctions of the telephone network, internet, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury.

Any attempt made by any person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of applicable law. Should such an attempt be made, QU reserves the right to seek damages from any such person to the fullest extent of the law.

QU reserves the right to withdraw, terminate or modify all or any part of this Contest at any time if for any reason the Contest is not capable of running as planned, including technical failure or corruption, computer virus, tampering, unauthorized intervention, fraud or any other cause beyond the control of QU which in the opinion of QU affects the administration, security, fairness, integrity or proper conduct of this Contest.

8) YouTube
This Contest is not in any manner sponsored, endorsed, administered by, or associated with YouTube. By participating in the Contest, each entrant releases and agrees to indemnify YouTube and hold it harmless from and against any and all costs, claims, damages, (including, without limitation, any special, incidental or consequential damages), or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Contest, or arising out of participation in any Contest-related or prize-related activity, or the receipt, enjoyment, participation in, use or misuse, of any Contest or prize- related activity, whether hosted by QU or a third party.

10) Law
These are the official Contest Terms and Conditions. The Contest is subject to applicable federal, provincial and municipal laws and regulations. The Contest Terms and Conditions are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over QU. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Terms and Conditions or the rights and obligations as between the entrant and QU in connection with the Contest shall be governed by and construed in accordance with the laws of the province of British Columbia including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

11) Language Discrepancy
In the event of any discrepancy or inconsistency between these official Terms and Conditions and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the Contest Terms and Conditions shall prevail, govern and control.

3) Road Show Photo Contest

Participation in this Contest constitutes acceptance of all rules and decisions, consent to use and release of claims. This Contest is void where prohibited by law, and all federal, provincial and municipal laws apply.
To be eligible for prizes in this Contest, you must be a legal resident of the Province of British Columbia, and must be at least 19 years of age.

The information you provide is being submitted to The Heart & Stroke Foundation of B.C. and Yukon’s Quitters Unite campaign (“QU”). This information will only be used in the ways set forth in these terms and conditions.You can enter this contest by having your picture taken by the QU Roadies at one of their many events around British Columbia.

1) THE CONTEST

Finalist Faceoff Ammendment: Voting for the “Quitters Unite Finalist Faceoff” (“Contest”) will begin on December 28th 2010 at 9:00:00 AM PST and will run until January 4th at 9:00:00 PM PST.

Voting for the “Quitters Unite Photo Contest” (“Contest”) will begin on October 12th 2010 at 9:00:00 AM PST and will run until November 30th at 11:59:59 PM PST.

2) CONTEST ENTRY

Finalist Faceoff Ammendment: The Quitters Unite Finalist Faceoff is open to the potential prize winners of the Quitters Unite Photo Contest (please refer to the Photo Contest Terms and Conditions for an explanation on how these potential winners were chosen). The potential prize winners will be contacted by Quitters Unite and will be required to sign a release acknowledging that they understand these Terms and Conditions.

The photos of the entrants, originally taken by the Quitters Unite Roadies and entered in the Quitters Unite Photo Contest, will be posted in a Facebook gallery on the Quitters Unite Facebook Page at or around 9:00:00AM PST on December 28th. The entrant who generates the most ‘Likes’ for their photo by 9:00:00PM PST January 4th, using the ‘Like’ feature on Facebook, will be declared the grand prize winner and will be awarded a Macbook. The remainder of the contestants in the Finalist Faceoff will receive iPads.
To win you will need to tell people about your photo and have them ‘Like’ it. Only ‘Likes’ generated directly on the photos in the Quitters Unite finalist album will be counted. 

The Quitters Unite Road Show will be traveling across British Columbia and stopping at post-secondary schools and other locations. The Quitters Unite Roadies will be providing props at their promotional “footprint” and taking pictures of guests. The goal of the contest is for you to create the most interesting and/or humorous photo you can using these props. Once your photo is taken by the roadies, it will be automatically uploaded to the QU webpage. You will then be provided the information you need to find your photo on the web. Once you find your photo, you will have to agree to these Terms and Conditions, and then you can complete your profile on the Quitters Unite website and confirm that it is your entry into the contest. That’s all you have to do to get entered. There may be multiple people in a photo, but only the one person who submits their information to the Roadies will be able to enter the photo into the Contest and be eligible for a prize.

To win you will need to tell people about your photo, as the entrant of the photo with the most votes at the end of the Contest will win the grand prize: a Macbook. Additionally, the entrants with the most votes in each of 5 regions where the Quitters Unite Road Show stops (regions are identified by health authority geographical boundaries: Northern, Interior, Vancouver Island, Vancouver Coastal, and Fraser) will win an 16GB iPad with WiFi. In the region where the grand prize winner resides, the regional prize will be awarded to the entrant of the photo with the second most votes.

To vote, people will simply go to the QU website. There they will find the photo they want to vote for and click on vote. They will be able to vote for as many photos as they like but only once per photo per day.
By entering in this Contest you agree to the Terms and Conditions set out above and below, so be sure to read them carefully. The decisions of QU will be considered binding in all affairs related to this Contest. QU reserves the right to disqualify entrants at their sole discretion if it is reasonably suspected that an entrant has tampered with the entry process, the Contest, or the website, or is acting in an uncooperative, unsportsmanlike, disruptive, abusive, or threatening manner.

QU reserves the right to make substitutions of equivalent kind or approximate value to the prizes listed above in the event of unavailability of any of the prizes or any component thereof. QU will not be liable to a winner or any other person for failure to supply the prize or any part thereof, by reason of the prize becoming unavailable or impracticable to award, or for any force majeure event, technical or equipment failure, terrorist acts, labour dispute, or act/ omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause similar or dissimilar beyond the control of QU. No substitution for or transfer of any prizes by a Contest entrant will be allowed.

3) ELIGIBILITY

Finalist Faceoff Ammendment: To be eligible for the Contest, you must be a potential prize winner from the original Quitters Unite Photo Contest, as determined by Quitters Unite representatives. All eligible participants will be contacted by Quitters Unite to discuss participation and the signing of a release.

People from all over the world are welcome to have their pictures taken, but only Residents of British Columbia will be eligible for prizes. Potential winners may be asked for proof of residency which may require them to send in a photocopy of government issued identification. Prizes and any mail addressed to a potential winner will only be sent to addresses in B.C. The Contest is void where prohibited or restricted by law. Entry to this Contest is only open to persons of at least 19 years of age.

This Contest is not open to anyone affiliated with Quitters Unite, NewAd, Domain 7, DesignStamp, Context Research, The Heart and Stroke Foundation of B.C. and Yukon, or The Ministry of Healthy Living and Sport.

4)    PHOTO REQUIREMENTS
All photos submitted to this Contest will be taken by QU Roadies. Qualifying photos may not contain representations of obscene language or content, including but not limited to: nudity, profanity, or graphic violence. If you are having problems registering your photo, please contact us at info@quittersunite.com. If problems persist we will do our best to help but we accept no responsibility for an entry that misses out on our Contest due to technical difficulties, including but not limited to lost photos, transmission difficulties, website issues or computer failure.

5) PROPRIETY OF A PHOTO’S CONTENT
Entrants in this Contest are responsible for any copyright infringements caused by their photos. QU assumes no responsibility for fees or royalties for anything or anybody contained in the photos.

A photo:

(i) cannot contain, mention, refer or otherwise allude to any sexually explicit or suggestive, obscene, lewd, violent, illegal, offensive, disparaging or inappropriate words, abbreviations, language, signs, products, symbols, political, personal and/or religious references or statements, (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group;

(ii) cannot promote illegal drugs or tobacco (obviously!), firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;

(iii) cannot in any manner defame, misrepresent, contain disparaging remarks or reflect negatively about QU, its products or other people, products or companies or their products, or in any way reflect negatively upon such parties or communicate messages or images inconsistent with the positive images and/or goodwill with which QU wishes to be associated, as determined by QU in its sole discretion;

(iv) cannot contain any personal identification, such as license plate numbers, email addresses or street addresses, without permission;

(v) cannot depict, and cannot itself be in violation of any law; and

(vi) must otherwise be in compliance with all of the provisions of these official Terms and Conditions as stated herein. As also stated above and below in these official Terms and Conditions, the posting of a photo does not mean the photo has been deemed to be in compliance with these official Terms and Conditions and QU reserves the right at any time during the Contest period to remove the posting of a photo from the Website or any website controlled by QU if it determines, in its sole discretion, that a photo does not comply with these official Terms and Conditions or that otherwise contains prohibited or inappropriate content and in the event of such removal, the photo will be disqualified and will not be eligible to compete for prizes.

6) NOTIFICATION OF POTENTIAL WINNERS
QU will contact winners by email as provided on the site registration. The winning photo will be announced on the QU website, as well as the QU Facebook page. QU is not responsible for mistyped, stolen, lost, or misdirected email. If QU is unable to make contact with a prize winner within (14) days of attempted contact, or a prize winner fails to claim the prize in accordance with these official Terms and Conditions, the prize will be awarded to the photo with the next highest vote count. In order to claim their prizes, the winners will be expected to cooperate with QU to get all necessary releases in place for their winning photos, and potential winners will be required to answer a skill testing question prior to being named a winner. Instructions on how to claim prizes will be provided in the winner notification emails.

7) REPRESENTATIONS/WARRANTIES; GRANTS/WAIVERS; AND INDEMNIFICATION/RELEASE AS CONDITIONS OF ENTRY
By submitting your photo to QU in relation to the Contest you represent, warrant and undertake to QU that your photo

(i) is your own original work and that you have the sole right to submit it to the Contest;

(ii) does not violate in any way rights of third parties including copyright and other intellectual property rights and

(iii) does not violate any applicable laws

In the event that you breach any of your representations, warranties or undertakings contained herein QU shall be entitled to and may seek indemnification from you for recovery of all legal fees, damages, claims and other expenses that may be incurred by QU or its affiliated entities as a result of your aforementioned breach.

Your contribution to the Contest should not include any content whatsoever which would reasonably be understood to be defamatory, threatening, distasteful, racist, discriminating, unlawful or otherwise objectionable.

QU reserves the right to alter or modify your contribution to the Contest without notification or consent from you.

QU reserves the right to change these Terms and Conditions at any time and at its sole discretion. Entrants agree to grant to QU an everlasting, royalty-free, assignable, exclusive license to use, utilize, replicate, alter, adapt, modify, publish, broadcast, translate, produce derivative works from, distribute, present, play, sublicense and exercise all copyright and other intellectual property rights with respect to your contribution worldwide and/or to include your contribution in other works in any media now known or later created forever. Each entrant agrees and grants QU permission to make available and display/perform and otherwise distribute entrant's first (given) name and photo submission in all media in perpetuity without compensation.
